Comprehensive Terms of Service for Maxima Discord Bot

Important Legal Notice
These Terms of Service constitute a legally binding agreement between you ("User," "you," or "your") and OxiaCode ("we," "us," "our," "Company," or "Service Provider") regarding your use of the Maxima Discord Bot ("Bot," "Service," or "Application"). By adding Maxima Bot to your Discord server, using any of its features, or interacting with the Bot in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety.
1. Definitions and Interpretation
1.1 Key Definitions
For the purposes of these Terms of Service, the following definitions shall apply:

"Content" | Any and all text, images, audio, video, data, information, or other materials transmitted, stored, or processed through the Bot |
"Discord Platform" | The Discord application, website, and associated services owned and operated by Discord Inc. |
"Intellectual Property" | All copyrights, trademarks, trade secrets, patents, and other intellectual property rights related to the Bot, including source code, algorithms, documentation, and branding |
"Personal Data" | Any information relating to an identified or identifiable individual user, as defined in applicable data protection regulations |
"Server Administrator" | A Discord user with administrative privileges in a Discord server who has the authority to add, configure, or remove bots and manage server settings |
"Third-Party Services" | External services, APIs, platforms, or applications that may be integrated with or accessible through the Bot |
"User-Generated Content" | Any content created, uploaded, transmitted, or submitted by users through their interaction with the Bot |
1.2 Interpretation Guidelines
In interpreting these Terms of Service:
- Singular and Plural: Words in the singular include the plural and vice versa unless the context clearly indicates otherwise
- Gender References: References to one gender include all genders unless specifically stated otherwise
- Headings: Section headings are for convenience only and do not affect the interpretation of the terms
- Including: The word "including" means "including without limitation" unless otherwise specified
- Legal References: References to laws, regulations, or legal concepts refer to those in force from time to time and include any amendments or replacements
- Business Days: References to days mean calendar days unless otherwise specified as business days
1.3 Scope and Application
These Terms of Service apply to:
- All users who interact with Maxima Bot directly or indirectly
- Server Administrators who add the Bot to their Discord servers
- Any person who accesses Bot-generated content or benefits from Bot services
- All uses of the Bot, whether for personal, commercial, educational, or other purposes
- All features and functionalities of the Bot, including future updates and enhancements
2. Service Description and Availability
2.1 Bot Functionality Overview
Maxima Bot is a comprehensive Discord bot application designed to enhance Discord server functionality through various automated and interactive features. The Bot provides services including but not limited to:

2.2 Service Availability and Performance
2.2.1 Uptime Commitment
While we strive to provide continuous service availability, we make no guarantees regarding uptime or uninterrupted service. We target:
- General Availability: 99.5% uptime on a monthly basis, calculated excluding scheduled maintenance periods
- Planned Maintenance: Scheduled maintenance windows will be announced at least 48 hours in advance when possible
- Emergency Maintenance: Unscheduled maintenance may occur without notice to address critical security issues or system failures
- Third-Party Dependencies: Service availability may be affected by Discord platform outages or third-party service disruptions
2.2.2 Performance Standards
We maintain performance standards to ensure optimal user experience:
- Response Time: Average command response time of less than 2 seconds under normal operating conditions
- Rate Limiting: Implementation of fair usage policies to ensure equitable resource distribution
- Scalability: Dynamic resource allocation to handle varying load demands
- Monitoring: Continuous system monitoring and automated alerting for performance issues
2.3 Service Modifications and Updates
Service Evolution: We reserve the right to modify, update, enhance, or discontinue any aspect of the Bot services at any time without prior notice. This includes but is not limited to adding new features, removing existing features, changing command syntax, modifying functionality, or altering service availability. While we will make reasonable efforts to communicate significant changes, users acknowledge that the service may evolve over time.
2.3.1 Update Categories

- Bug Fixes: Corrections to existing functionality to improve reliability and performance
- Security Updates: Patches and improvements to address security vulnerabilities or enhance protection

- Performance Optimizations: Improvements to system efficiency, response times, and resource utilization
3. User Responsibilities and Acceptable Use
3.1 General User Obligations
By using Maxima Bot, you agree to comply with all applicable laws, regulations, and these Terms of Service. Your responsibilities include:
3.1.1 Compliance Requirements
- Legal Compliance: You must comply with all applicable local, state, national, and international laws and regulations when using the Bot, including but not limited to laws regarding data protection, privacy, intellectual property, communications, and online conduct
- Discord Terms Adherence: You must comply with Discord's Terms of Service, Community Guidelines, and any other applicable Discord policies, as these govern the underlying platform on which the Bot operates
- Truthful Information: You must provide accurate and truthful information when configuring the Bot or interacting with its features, and you must not misrepresent your identity or authority
- Authorized Use Only: You may only use the Bot for purposes for which you have proper authorization, and you must not exceed the scope of your permitted access
- Security Cooperation: You must cooperate with security measures implemented by the Bot and must not attempt to circumvent, disable, or interfere with security features
3.1.2 Server Administrator Responsibilities
If you are a Server Administrator who adds Maxima Bot to a Discord server, you have additional responsibilities:
- Authority Verification: You represent and warrant that you have the necessary authority to add the Bot to the server and to bind the server and its members to these Terms of Service
- User Communication: You are responsible for informing server members about the Bot's presence, functionality, and data collection practices
- Configuration Management: You are responsible for properly configuring the Bot's features and ensuring that the configuration complies with applicable laws and server rules
- Moderation Oversight: While the Bot may provide automated moderation features, you remain ultimately responsible for server moderation and community management
- Compliance Monitoring: You must monitor Bot usage in your server and take appropriate action if you become aware of violations of these Terms of Service
3.2 Prohibited Uses and Activities
3.2.1 Strictly Prohibited Activities
Zero Tolerance Policy: The following activities are strictly prohibited and may result in immediate service termination and legal action:

3.2.2 Additional Prohibited Behaviors
Beyond the strictly prohibited activities listed above, the following behaviors are also not permitted:
- Resource Abuse: Excessive use of Bot resources that interferes with service availability for other users
- False Reporting: Making false or malicious reports about other users or content
- Impersonation: Using the Bot to impersonate others or misrepresent your identity or affiliation
- Circumvention: Attempting to bypass rate limits, access controls, or other protective measures
- Unauthorized Automation: Creating unauthorized bots or scripts that interact with Maxima Bot
- Data Mining: Systematic collection of data from the Bot for commercial or unauthorized purposes
3.3 Content Standards and Guidelines
3.3.1 User-Generated Content Requirements
All content transmitted through or processed by the Bot must meet the following standards:
- Lawful Content: Content must not violate any applicable laws or regulations
- Respectful Communication: Content should promote respectful and constructive communication
- Accuracy: Factual claims should be accurate and not deliberately misleading
- Appropriate Context: Content should be appropriate for the context in which it is shared
- Rights Compliance: Content must not infringe on the rights of others, including intellectual property rights
3.3.2 Content Moderation and Enforcement
We employ various methods to monitor and enforce content standards:
- Automated Detection: Automated systems that identify potentially problematic content
- User Reporting: Systems for users to report violations or inappropriate content
- Manual Review: Human review of reported content and automated flagging results
- Progressive Enforcement: Escalating consequences for repeated violations
4. Intellectual Property Rights
4.1 Our Intellectual Property
Maxima Bot and all associated intellectual property are owned by OxiaCode and are protected by applicable intellectual property laws. Our intellectual property includes:

4.1.2 Rights Reserved
All rights not expressly granted to you are reserved by OxiaCode. This includes:
- Reproduction Rights: The right to copy, duplicate, or reproduce any part of the Bot
- Distribution Rights: The right to distribute, share, or make available the Bot or its components
- Modification Rights: The right to modify, adapt, or create derivative works based on the Bot
- Reverse Engineering: The right to reverse engineer, decompile, or disassemble the Bot
- Commercial Use: The right to use the Bot's intellectual property for commercial purposes
4.2 User Content and License Grants
4.2.1 User Content Ownership
You retain ownership of any content you create, upload, or transmit through the Bot ("User Content"). However, by using the Bot, you grant us certain licenses necessary to provide the service:
4.2.2 License to OxiaCode
Content License: You grant OxiaCode a worldwide, non-exclusive, royalty-free, transferable license (with right to sublicense) to use, copy, modify, distribute, publicly display, and publicly perform your User Content solely for the purposes of operating, providing, and improving the Bot services. This license is limited to the extent necessary to provide the Bot functionality and terminates when you delete the content or cease using the Bot, except where continued storage is necessary for legitimate business purposes or legal compliance.
4.2.3 User Content Representations
By submitting User Content, you represent and warrant that:
- You own or have the necessary rights to grant the license described above
- Your User Content does not infringe on the intellectual property rights of any third party
- You have obtained all necessary permissions and consents for the content
- Your User Content complies with all applicable laws and these Terms of Service
- You will not submit content that contains proprietary information of third parties without authorization
4.3 Third-Party Intellectual Property
The Bot may integrate with or reference third-party services, APIs, or content. You acknowledge that:
- Third-Party Rights: Third-party intellectual property rights are owned by their respective owners
- No Transfer: Use of the Bot does not grant
